Property Ownership

Texas Property Code Section 5.021 establishes requirements for deeds to be valid. A Texas deed to be effective as a conveyance must contain all of the following EXCEPT:

AGrantor's signature
BLegal description of the property
CGranting clause (words of conveyance)
DRecording in the county deed records✓ Correct

Explanation

Recording is NOT required for a deed to be valid between the grantor and grantee. Texas deeds are valid between the parties when they are signed, delivered, and accepted. However, recording in the county deed records is required to provide constructive notice to third parties and protect against subsequent claims from other purchasers.
