Texas License Law

Texas real estate license holders are required to use TREC-promulgated forms when applicable. A license holder may use a different contract form only when:

AThe buyer or seller requests it
BA TREC-promulgated form does not exist for the specific transaction, or an attorney-drafted form is used✓ Correct
CThe transaction involves commercial property
DThe form is approved by the Texas Association of REALTORS

Explanation

TREC rules require license holders to use TREC-promulgated forms when they exist for the specific type of transaction. Exceptions exist when no TREC form is available for the transaction type, or when the parties use an attorney-prepared form. Commercial transactions and other specialized deals often use attorney-drafted contracts.
