North Dakota License Law

NDREC may revoke a licensee's license for all of the following EXCEPT:

AMisrepresentation in a transaction
BCommingling client funds
CCharging a commission higher than competitors✓ Correct
DFailing to disclose material facts

Explanation

Commission rates are freely negotiated; charging a higher rate than competitors is legal and not a disciplinary matter (it would actually be anticompetitive if the NDREC set rates). Misrepresentation, commingling, and failing to disclose material facts are all grounds for disciplinary action.
