Florida License Law
Under Florida law, a real estate license applicant who was convicted of a felony must disclose this on their application. FREC's decision on whether to issue the license will consider:
AOnly whether the applicant has been pardoned
BThe nature of the crime, time elapsed since the conviction, evidence of rehabilitation, and relationship to the practice of real estate✓ Correct
COnly whether the sentence has been completed
DOnly convictions within the past 5 years
Explanation
FREC considers multiple factors when evaluating applicants with criminal histories: the nature of the crime (especially crimes of moral turpitude or financial fraud are particularly relevant to real estate), how much time has passed, evidence of rehabilitation, and how related the crime is to the duties of a real estate licensee. Prior convictions don't automatically disqualify an applicant.
