New York's Property Condition Disclosure Act requires sellers of one-to-four family residential dwellings to deliver the PCDS to the buyer:

Explanation

Under the NY Property Condition Disclosure Act (RPL section 462), the PCDS must be delivered to the buyer no later than the signing of the contract of sale. If the seller fails to deliver a PCDS, the buyer is entitled to a $500 credit against the purchase price at closing (the seller's alternative to completing the form).
